Choosing a Location to Start Your Business in Betty’s Bay

Summary
When choosing premises to open a new business or even move an existing one there are so many things to consider that might influence the location – the one thing you can make easy for yourself is knowing from the get-go whether your business requires a location that has specific zoning. Trying to open a business in a location that does not have the correct zonal attributes could delay you, add additional cost to your project and ultimately might not be given the green light. Whereas marrying a business to the correct zone should be plain sailing all the way to your opening day.
In saying all of the above PLEASE ask your landlord / estate agent for a copy of the Title Deed that may be very specific about activities that CANNOT take place. Removing such restrictions can be time consuming and costly. Please discuss with the Town Planner of the Municipality.

It covers planned businesses in locations that are business and/or residentially zoned, various permits and permissions that might be required and how to go about being fully compliant with the Overstrand Municipality.
It is for people who either are leasing premises, have bought premises or who have finished building premises. Remember you may also need a business license to be granted before you start trading, covering areas such as Health and Safety and Fire compliance.

Business Zone 1 & 2 (B1 & B2)
Primary use without additional consent – Any ‘general’ business, conference facility, guesthouse/hotel, place of assembly, place of instruction and self-catering

Business Zone 3 (B3)
Primary use without additional consent: Shop, offices, restaurant and self-catering

 

Business Zone 4 (B4)
Primary use without additional consent: Petrol station

Industrial Zone 1 (IND1)
Primary use without additional consent: industry, agricultural industry, builder’s yard, factory shop, funeral parlour, motor repair shop, warehouse, workshop, service station, heavy vehicle service station

Community Zone 1 (CO1)
Primary use without additional consent: Clinic, day care, creche, place of assembly, instruction or worship

Transport Zone 1 (TR1)
Primary use without additional consent: parking garage, transport service

Agricultural Zone 1 (AGR1)
Primary use without additional consent: agriculture, creche, dwelling house, guest rooms, home occupation

Rural Zone 1 (R1)
Primary use without additional consent: smallholding, agriculture, creche, dwelling house, guest rooms, home occupation

Rural Zone 2 (R2)
Primary use without additional consent: conservation use, dwelling house, home occupation, guest rooms

Rural Zone 3 (R3)
Primary use without additional consent: agri-village, creche, town housing, private open space, private road

Residential 1 (SR1) (single)
Primary use without additional consent: creche, dwelling house, guest house, home occupation

General Residential 1 (GR1)
Primary use without additional consent: town housing, private open space, private road

General Residential 2 (GR2)
Primary use without additional consent: town housing, private open space, private road

General Residential 3 (GR3&4)
Primary use without additional consent: flats and townhouses

Less Formal Development Zone (LFD)

 

 

Primary use without additional consent: creche, dwelling house, guest house, private road, private open space

Residing in Business Premises
B1,2 & 3 flats for accommodation are allowed without any additional consent as long as they are above the ground floor.

Businesses that require permits from OM
Permits for businesses relates to food preparation and the selling of secondhand goods. The application can be lodged at the Area Manager’s Office, Kleinmond. The lady dealing with the is Carla Swartz: Tel 071 8419.

 

Important: if the property has an approved building plan, make sure that the building on the property is legal and was built according to plan. Also take notice if the property is subject to the Environmental and Heritage Overlay zones.
